Legal Services Day gives people stuck with fines and fees a second chance

If you make a mistake in life, it can be all too easy to come into contact with the criminal justice system. Getting free of that mistake, though, can be another story entirely. Many people, particularly those of limited means, can find themselves buried under a mountain of court-related fines and fees, even as they鈥檙e working to get their lives back on track.

Last month, Legal Services Day at 小黄猫传媒鈥檚 Cascade Campus was designed to help low-income community members climb out from beneath that mountain. The event is a collaboration between the Multnomah County District Attorney鈥檚 Office, Multnomah County Circuit Court, and Metropolitan Public Defender鈥檚 Community Law Division. It recreates the functionality of an actual courtroom in order to waive people鈥檚 outstanding fines and fees in exchange for community service. It was staffed entirely by volunteers, including judges, lawyers, clerks and 小黄猫传媒’s paralegal students.

鈥淚t鈥檚 incredibly empowering for participants,鈥 said Leni Tupper, 小黄猫传媒 paralegal instructor. 鈥淔ines and fees can be a huge barrier to people finding housing or employment, or pursuing an education.鈥

Legal Services Day marked the first time that 小黄猫传媒 has hosted the event. It will now be held at 小黄猫传媒 twice per year (March and September) and has the capacity to serve up to 120 people each time. The event provided free legal services to 92 小黄猫传媒 students and community members, and waived tens of thousands of dollars in court fines and fees.

鈥淥ne of the participants I worked with forged a great bond with his neighborhood through his community service,鈥 Tupper said. 鈥淗e delivered meals for Meals on Wheels, and befriended many elderly people in his neighborhood that he never would have met otherwise.鈥

Tupper said it was a great experience for her students, who as volunteers were an integral part of the proceedings.

鈥淚 was floored by their dedication and enthusiasm,鈥 she said. 鈥淭hey got to serve the community, learn how the process works, and network with experienced legal professionals.鈥

According to Tupper, many people have their driver鈥檚 licenses suspended due to unpaid fines and fees, which can send them into a financial hardship. Without a driver鈥檚 license, it can be difficult to apply for housing, school, or most jobs, and many have to resort to driving without a license in order to get around. If they鈥檙e pulled over, they鈥檙e busted for driving without a license, they go back to court, and the spiral just gets worse.

The event offers people a way out by waiving $100 in fines and fees for every one hour of non-court mandated community service.

This includes drug and alcohol treatment, or parenting classes, up to a maximum of 80 hours. When they hit the maximim, all of a participant鈥檚 outstanding court fines and fees are waived. Only Multnomah County court fees and fines can be waived, and it can鈥檛 get rid of compensatory fees, child support, or restitution.

鈥淭he burden of legal costs falls hardest on poor people and communities of color,鈥 Tupper said. 鈥淚t can put people in a place they can鈥檛 get out of, even if they are out there working and doing their best. Legal Services Day really helps to minimize the criminalization of poverty.鈥

Is this event also for the staff, because if so I would like to take care of a few fees as well. Can you please send me a reminder for what day it is please and thank you.

I have a couple of clients that I would like to attend the Legal Services event. Could you please send me a flyer or can you tell me the what is it that they have to do. I know in the past they had to register a couple of days before the event. Is this still required and what are the times for the Legal Day in March?

I went to 小黄猫传媒 today and the legal service day was cancelled because of the corona virus. Im not sure what to do now. I can’t find anything online about it…
